The terms, conditions and circumstances of the Ludwig-Johnson horse -trade were aired in Justice Caldwells Court Tuesday morning. The complainant, A.

Ludaig, came into Court reinforced by two witnesses, D. Ban-chero and Mrs. Boetto. The defendant, Charley Johnson, was supported by his wife and two daughters. Both aides claimed that there were other witnesses who might testify to variou phases of the controversy.

Both principals agreed that they had talked trade. Ludwig offered to give tiis one horBe for Johnsons span. It was something the same kind of a lay aa when Wall Kennedy offered to trade the traveler two $5 dogs for a $10 dog, with the conditions Bomewhat reversed. Ludwig took his horse to Johnsons place to show his pulling ability. John son did not have time to witness the trial of strength at that time so went away to tiis work, leaving Ludwig at the place.

Ludwig hauled some hay from the field to Johnsons barn and says that Mis. Johnson was very well pleased with the performance of the horse, so, believing that everything was satisfactory, he put his horse in the pasture and took one of Johnson's and cauie to town, promising to return for the other horse later. When Johnson came home and found that Ludwig had closed the deal he sent his gills into town to tell Ludwig that he was not satisfied with the trade and wanted the horse returned. Lndwig did not return the animal, so Johnson came into town, found the horse in the Boetto stable and took it home. Ludwig got out a search warrant to recover the horse and charged Johnson with stealing it.

Call of Tuesday morning announces that Governor Gage will call an extra session of the Legislature, and accompanies its assertion with information that tends to give it statements the color of truth. The Caff Bays: Governor Gage will call an extra session of the Legislature.

Gage, Herrin, Burns and their followers may deny this assertion, but the Governor will issue the proclamation when Burns signifies that everything ie in readiness for the event. The Call knows whereof it Bpeaks when it asserts that Gage will call the pecial session. Aa General Barnes is out of the race for the Senatorsbip and U. 8. Grant, signifies a disposition to retire from public life, the followers of Burns believe that the Mexican can win out.

Agents of Burns and Herrin are canvassing the State to eound the feeling of legislators on the topic of an extra session. Ten days ago the Call received authentic intelligence regarding the route and inquiries of one of the canvassers. Burns has finally decided that Gage shall call the extra cession this year. At first the Governor made some show of resisting the decree of the Mexican, but the reeiatance was alight. At one time Gage came out openly with a precise statement that be would not call tbe members of the Legislature together in special session, but bis mind has undergone a change since he made that declaration.

He will issue the proclamation, probably within sixty days time. Last Sunday, Burns, at the close of a conference on tbe subject of State patronage, sail to one of the men attending the conference Governor Gage will call an extra session of the Legislature within sixty days. This has been positively decided upon. Tbe United States Senate is not going to seat Matt Quay on the Governors appointment. It is all bosh to suppose that the Senate is going to reverse itself, A commission by executive appointment would leave me out of the reckoning.

Tbe only thing to do is to call an extra session. Gage and I have decided that this theory of allowing the newspapers to beat us out will not go, Tbe papers may crow now, but we will show them who will do the crowing at the finish. Herrin, Gage, Burns and the Mexican push generally are deluded if they im agine that tbe canvasa of tbe State to promote an extra session was concealed from the press. The Call knew ftie day and hour that Dr. Maggard was inter viewed by the railroad agent who represented himself aa a correspondent at' tached to a news syndicate.

M. Turton, Secretary of the local tent, received the check Monday. The new winery at Geyscrville has contracted for grapes at $10 and $12 per ton on a basis of 22 per cent sugar. The Zinfandel on that basis will bring $12 and the mission $10. As many visitors are expected in town on the 3rd as well as the 4th of July, it is suggested that those intending to decorate their places of business do so this week.

All persons holding books belonging to the Free Library are requested to return the same promptly this week, in order that the books may be ready to reissue immediately alter the Fourth. Judge Burnett, of Santa Rosa, lias rendered a decision in the case of tbe Napa State Hospital vs. J.T. Cunningham, as guardian of an incompetent person, which will be of interest generally throughout Hie State. The plaintiff brought suit for the care of said incompetent for nine years at $15 per month. The Judge gave plaintiff judgment for three years at $15 per month.

Id his opinion the Judge said The only question is whether the claim for the care and ma.ntenance of the insane is barred by the statute in two or three years. After carefully considering the matter and reviewing the authorities cited, I have reached the conclusion that the liability ia one created by the Boys, youll have money left for other purposes if you let us supply your II. March of Chiles valley came to Napa Tuesday to get married. The young lady is 18 years of age, but the young man has not reached his majority and was informed that he would have to secure the written consent of his parents or guardian before he could obtain a license. As both of his parents reside in another State, he was in a quandary as to what to do. County Clerk Collins suggested that he might have a guardian appointed. He gladly accepted the sug gestion, and started out to find some one who would consent to his marriage with the lady of his choice.
